Paedophile abused four-year-old girl in cubicle of swimming pool

A man who sexually abused a four-year-old girl and filmed it at a swimming pool has been jailed for six years.

Roman Bardzik, 54 was found guilty of molesting the child in a changing cubicle at Fraserburgh Swimming Pool in February 2011.

During his trial the jury had to watch video footage he recorded while the offences were taking place.

He was also found guilty of taking indecent pictures of the girl, but was cleared of more serious sexual offences including rape.

Bardzik came to the UK from Poland nine years ago. The court heard he originally tried to blame someone else for the offence.

During sentencing Lord Pentland told Bardzik: “You have little insight into the effects of your offending on your victim.”

He added: “Instead of looking after her and protecting her you sexually abused her for the purpose, I can only infer, of your own sexual gratification.”

As he was led to the cells at the High Court in Edinburgh Bardzik began to sob and gesture towards the public benches. He will be deported when his sentence is complete

At the High Court in Edinburgh Lord Pentland sentenced Roman Bardzic to 6 years imprisonment after he was convicted of the sexual abuse of a child in 2011.

On sentencing Lord Pentland made the following statement:

“Roman Bardzic, the jury convicted you after trial of three charges of sexual abuse of a child when she was just 5 years old.

The first charge involved you on various occasions inducing the child to masturbate you to the emission of semen when she was alone in your care at your home.  There was evidence at the trial from the child’s mother that the child visited you in or around 2011 on about 20 occasions.

Charge 3 was an offence of sexually assaulting the child by touching her on her vagina at a swimming pool on 19 February 2011.  The film you took of this showed you repeatedly handling the child’s vagina with your fingers whilst she was getting undressed in a cubicle with you and then after she had been swimming when you were supposed to be helping her get dressed. 

Charge 4 concerned indecent photographs which you took of the child at the swimming pool in the cubicle on the same date.  You took these photographs using a camcorder, which you had taken with you to the swimming pool.

These offences involved a gross breach of trust on your part.  You were entrusted with the care and welfare of the child by her mother.  Instead of looking after her and protecting her, you sexually abused her for the purposes, I can only infer, of your own sexual gratification. The offences amounted to very serious abuse of a young child whilst she was in your care and under your protection. 

I note from the social work report that you continue to deny your guilt and to ascribe responsibility to others. You have little insight into the potential effects of your offending on your victim and continue to be focussed principally on the effect of these matters from your own perspective.

The circumstances surrounding the offences suggest that there may well have been an element of grooming or planning behind them in that you made arrangements for the child to visit you on her own and not with her older brother.

I have taken account of all that has been said on your behalf and of the contents of the social work report.

In all the circumstances, I consider that you must go to prison for a period of 6 years.  This is a cumulo sentence imposed in respect of charges 1, 3 and 4 on the indictment.

The sentence will be backdated to 31 May 2013 when you were first remanded in custody.

I have already made the appropriate orders under the Sexual Offences Act 2003 concerning the notification requirements with which you must now comply and under and the Protection of Vulnerable Groups (Scotland) Act 2007; your name will be added to the list of persons deemed unsuitable to work with children.

After your sentence you will be deported from the United Kingdom.”
